A face-to-face appointment will be arranged at the client's residence to carry out a comprehensive assessment as per instruction.
The assessment consists of a combination of established models, clinical judgment, and their specialised knowledge to form an opinion relevant to the legal case. Nursing process is included, which involves the assessment, planning, implementation and evaluation to structure the report appropriately.
Additionally validated, verified and widely used models such as Activities of Daily Living, Roper Logan &Tierney (2000), will be used.
A structured, forensic review of all relevant medical records and documentation will be completed.
This includes a chronological analysis of the patient’s clinical history, care pathway, and the event or condition under investigation.
The report presents a clear, objective narrative that translates complex medical terminology into accessible language for legal professionals and the court.
The cost of care report is a comprehensive document that outlines the current and projected expenses associated with an individual's ongoing medical and supportive care needs, often used in medico-legal contexts to establish damages or compensation.
As per best practice and legal requirements, the report is be devised through a thorough clinical assessment, incorporating detailed documentation of the patient's injuries, needs, and the resources required for their care. It is objective, evidence-based, clearly articulated, and disclosed in accordance with legal protocols to facilitate fair and informed judicial decision-making.
Clinical Practice Assessment involves the systematic evaluation of a healthcare professional's practices against established clinical guidelines and standards to ensure quality, safety, and consistency of care.
A Standard of Care Review will then examine whether the healthcare provider’s actions met the accepted level of competence and care expected within the profession at the relevant time.
These assessments inform medico-legal solicitors by providing an objective analysis of the healthcare delivery, identifying deviations or adherence to accepted standards, and supporting expert opinion on the appropriateness and quality of care provided in relation to the case this includes compliance with the Nursing and Midwifery Board of Ireland (NMBI) Code of Professional Conduct, The impartial, clinically sound, and legally structured report will assist the court in determining whether a breach of duty occurred and if it contributed to the alleged harm.
As an Expert Nurse Witness, I provided independent, clinically grounded testimony in medical negligence and personal injury cases.
My role is to assist the court by explaining complex nursing and healthcare issues in clear, objective terms. This includes presenting findings from the forensic review of medical records, cost of care assessments, and standard of care evaluations.
The evidence provided is impartial, evidence-based, and designed to support the court in determining liability, causation, and appropriate compensation.
